1. INTRODUCTION

1.1 You will be able to access most areas of this Website without registering your details with us. Certain areas of this Website are only open to you if you register.

1.2 We may revise these terms and conditions at any time by updating this posting. You should check this Website from time to time to review the then current terms and conditions, because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this Website.

2. ORDERING FROM US

2.1 You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.

2.2 Our acceptance of an order takes place when we despatch the order. We will send you a despatch confirmation by email. When we despatch the order the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your order or you have cancelled your order.

2.3 We may refuse to accept an order:
(a) where goods are not available;
(b) where we cannot obtain authorisation for your payment;
(c) if there has been a pricing or product description error; or
(d) if you do not meet any eligibility criteria set out in our terms and conditions.

3. PRICING

3.1 All prices include VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price.

3.2 Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this Website.

3.3 Our prices are reviewed periodically and often changed

 

CANCELLATION AND RETURNS POLICY.

4.1 If you wish to cancel your order:
(a) you can notify us by email to sales@xtremebikes.co.uk before we have dispatched the goods to you; or
(b) where goods have already been dispatched to you, by returning goods to us in accordance with clause 4.2 below.

 

4.2 You can return goods within 14 days of receipt for a full refund or exchange, Providing the Goods and in original packaging and Fit for resale. The costs of returning goods to us shall be borne by you.
(Please note: some electrical components are none returnable, Motors, Speed controllers, Batteries, Wiring looms, Throttles and Chargers are none returnable)

 

4.3 Upon receipt of the goods we will give you a full refund of the amount paid or an exchange credit as required, Refunds are made via the same Payment method Received.

 

4.4 The rights to return the goods in clause 4.3 will not apply in the following circumstances: - in the event that the product has been (Used, Damaged, Modified, Broken) where the products are magazines or newspapers. The provisions of this clause 4.4 do not affect your statutory rights.

 

4.5 Goods ordered in error: We will refund payment for any product ordered in error, Providing it is returned to us at your expense and is received in the same 'New' condition that it left our Company. If any items are returned to us in a none saleable condition we have the right to refuse you a Full Refund.

 

4.6 Faulty / Damaged Goods: You must take full responsibility for checking over all goods and packaging when accepting one of our Products. If needed you should make the delivery driver wait briefly making sure the parcel and contents are of satisfactory condition before accepting your order. In the unlikely event that the goods showing signs of damaged, you must either sign for the goods as damaged and make a note on the Drivers paperwork, or alteranatively Refuse the Parcel and let it be returned. ( Once Accepting the Goods) If you sign for the goods with no note to the driver, we must assume that they were in good condition when delivered Packaging was of good appearance and you are happy to acceptance of the goods.

 

In the Event of any Unforeseen Damages, You must notify us within 24 hours upon taking delivery of your parcel either by email or telephone. After this time it will not be possible for us to raise a claim for damages received in the Care of the Delivery Company. Depending upon the extent of the damage, we may be able to send out new replacement parts or you will be asked to return the goods in their original packaging (wherever possible) In the event you are asked to return the goods, you will be offered a repair /replacement, providing there is no evidence of Misuse, User Damage or Customer Breakages . Damaged items must be reported within 24 hours of receiving the goods
The provisions of this clause 4.4 do not affect your statutory rights.

5.  LICENCE.

 

5.1 You are permitted to print and download extracts from this Website for your own use on the following basis:
(a) no documents or related graphics on this Website are modified in any way;
(b) no graphics on this Website are used separately from accompanying text; and
(c) any of our copyright and trade mark notices and this permission notice appear in all copies. Xtreme Bikes owns the rights to all pictures and wording displayed on our website. We do not allow any third parties to use any of our pictures or text from this website, do not use, reproduce, modify or distribute our images or any part of those images in any manner.

5.1 Unless otherwise stated, the copyright and other intellectual property rights in all material on this Website (including without limitation photographs and graphical images) are owned by us or our licensors. For the purposes of these terms and conditions, any use of extracts from this Website other than in accordance with clause 5.1 above for any purpose is prohibited. If you breach any of the terms in these terms and conditions, your permission to use this Website automatically terminates and you must immediately destroy any downloaded or printed extracts from this Website.

5.2 Subject to clause 5.1, no part of this Website may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without our prior written permission.

6. SERVICE ACCESS

6.1 While we endeavour to ensure that this Website is normally available 24 hours a day, we will not be liable if for any reason this Website is unavailable at any time or for any period.

6.2 Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.

7. VISITOR MATERIAL AND CONDUCT

7.1 Other than personally identifiable information, which is covered under the Privacy Statement below, any material you transmit or post to this Website will be considered non-confidential and non-proprietary. We will have no obligations with respect to such material. We and our nominees will be free to copy, disclose, distribute, incorporate and otherwise use such material and all data, images, sounds, text and other things embodied therein for any and all commercial or non-commercial purposes.

7.2 You are prohibited from posting or transmitting to or from this Website any material:

9. REGISTRATION

9.1 To register with www.xtremebikes.co.uk you must be over eighteen years of age.

9.2 Each registration is for a single user only. We do not permit you to share your user name and password with any other person nor with multiple users on a network.

9.3 Responsibility for the security of any passwords issued rests with you and if you know or suspect that someone else knows your password, you should contact us immediately.

9.4 We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these terms and conditions.

10. DISCLAIMER

10.1 While we endeavour to ensure that the information on this Website is correct, we do not warrant the accuracy and completeness of the material on this Website. We may make changes to the material on this Website, or to the products and prices described in it, at any time without notice. The material on this Website may be out of date, and we make no commitment to update such material.

10.2 The material on this Website is provided “as is” without any conditions, warranties or other terms of any kind. 11.2 Nothing in these terms and conditions shall exclude or limit our liability for (i) death or personal injury caused by negligence (as such term is defined by the Unfair Contract Terms Act 1977); (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability which cannot be excluded or limited under applicable law.

11.3 If your use of material on this Website results in the need for servicing, repair or correction of equipment, software or data, you assume all costs thereof.

11.4 You agree to indemnify us fully, defend and hold us, and our officers, directors, employees and agents, harmless from and against all claims, liability, damages, losses, costs (including reasonable legal fees) arising out of any breach of the terms and conditions by you, or your use of this Website, or the use by any other person using your registration details.

11.5 Xtreme Bikes shall not be liable for any failure to perform its obligations under this agreement if caused by matters beyond our reasonable control. All goods are delivered by third party couriers and we are reliant on them. We cannot accept any responsibility if they fail to perform.

11.6 The products should be used only under strict adult supervision at all times. Under no circumstances should the products ever be used in areas where other vehicles may be driving. Under no circumstances should any product be used where there could be danger to a child or adult.

11.7 Mini bikes, quads, scooters are not ROAD LEGAL and should under no circumstances be used on the public roads. The purchaser is solely responsible for the use of the mini moto and must strictly adhere to all governmental laws that are in force. Do not use on wet, oily or icy surfaces. The mini moto is designed for both adults and children from 16 years upwards, but children should be supervised at all time when riding the bike by a responsible adult.

11.8 Purchaser accepts FULL responsibility & releases Xtreme Bikes of ANY and ALL PERSONAL INJURIES, FATAL INJURIES, ANY LOSSES , COSTS, OR DAMAGES incurred as a result of the Purchaser's operation of this item. The purchaser is solely responsible for the maintenance and safety of the mini moto and when permitting other riders to ride this item and assumes all responsibility in event of damages, injuries or fatal injuries etc. Purchaser is solely responsible for understanding and abiding by all governmental/ police laws for operation of this product

12. GOVERNING LAW AND JURISDICTION

12.1 These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.

12.2 We do not warrant that items for sale on the Website are appropriate or available for use outside the United Kingdom. It is prohibited to access the Website from territories where its contents are illegal or unlawful. If you access this Website from locations outside the United Kingdom, you do so at your own risk and you are responsible for compliance with local laws.

13. MISCELLANEOUS

13.1 You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions

13.2 If any provision of these terms and conditions is found by any court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have full force and effect.

13.3 Only the parties to these terms and conditions may seek to enforce them under the Contracts (Rights of Third Parties) Act 1999.

14. DELIVERY

ALL GOODS OVER £50 are delivered via a carrier service, between 8:30am and 5:30pm Monday - Friday, and require a signature upon receipt and the following applies: UK Mainland Customers - Delivery is made by carrier, If you cannot arrange for someone to be available to sign for the goods, please let us know immediately for an alternative delivery date or alternative delivery address to be scheduled.

Delivery charges: These are priced per item based on weight and value; Special rates apply for bulk orders. We reserve the right even after confirming your online order via email to obtain quotes from delivery companies for the cost of delivery of your item and if delivery cost is found to be more than the price previously charged to give you the option to pay the extra to have it delivered or to have a full refund. We will not be obligated to deliver the item at the previously charged price and put us in a loss making situation.

Please note: The couriers are contracted to deliver to the kerb of the delivery address. They are not contracted to carry the product beyond the kerb and you may be required to carry the item from the kerb to your premises.

We aim to despatch goods within 24hrs of completion of payment process for orders paid by credit/debit card or postal order. Orders paid by cheque will not be despatched before clearance of cheque. We will post items via the delivery method selected however we accept no responsibility for loss, damage or late delivery through no fault of our own. In certain cases it may be possible to claim compensation for lost items however we need to be notified within 7 days that the product has not arrived else we will not be able to claim and you may lose the money spent on that lost item. In the exceptional circumstances where we find we are at fault ie lost order, we will send the item and as soon as it has been brought to our attention. The following applies to goods ordered over the value of £50 or of a large nature items below will generally be dispatched via our preferred delivery company.

UK Offshore Customers/EU Customers - As above except delivery is between 2 - 7 days depending on destination country. You will be notified of an approximate delivery date. International Customers - As above except once posted it is out of our control. Upon ordering a product for international delivery you are accepting that if for any reason the goods are held up or seized at your countries customs it is your responsibility to try and have them released and any costs incurred or loss is accepted by you. You also need to be aware that our delivery costs do not include any duty or taxes that may be payable in your country. If you are not happy with this, with the greatest of respect, please do not order from us. If you wish to purchase a product for delivery outside mainland UK, we will obtain a quote from reputable shipping companies and inform you of the cost or you can use your own shippers. If you need to return the product for any reason whatsoever your shipping charges are not refundable and you will have to bear the cost of return shipping for the product. If your product has been sent to a location outside mainland UK and it is subject to a warranty claim, you are liable for all shipping associated with getting it fixed or replaced.

15. WARRANTY

Xtreme Bikes offers 30 days free replacement part guarantee from the date of purchase. This covers manufactures defects only, and does not cover User Error, Breakages, Misuse, Engine Seizers, Accidental damage and Broken Parts which may have been done by the owner/ rider, What we do offer is to replace any agreed Manufacturing Defect parts which have become defect under normal gentle off road use. Our offer is to replace any part which we agree has become defective by general everyday use and you will be required to return any faulty part back at your expense for inspection and re-fit the new part as soon as possible. Batteries, Chargers and Motors are expressly excluded from any Guarantee. Please note all off road Products sold by Xtreme Bikes are designed for (Gentle off road use only) all products should be used on Smooth, Dry, Flat Terrain, our products are not designed for off tracks, gradient or hilly ground and should never be use on wet, slippery, loose, uneven, muddy or sandy surfaces. Damages arising from inappropriate use will not be covered under any of our warranty terms and conditions. (Electrical Components) Batteries / Speed controllers come with 3 months return to base warranty from date of purchase - 

We strongly advise that the customer or someone they know should have good mechanical knowledge of Off Road Products who can carry out the initial assembly and also the servicing and general maintenance or repairs on any mechanical product bought from this site. You should expect to have to change parts on any of these products and we would expect that you the customer will be able to carry out these repairs. We strongly recommend if you are unable to do so or do not know someone with the capability to do these checks and repairs that you do not purchase these items from this site.

Please note that with all Mini Moto products we offer a 30 day parts-only warranty. Once the machines have been started and used they cannot be returned for a cash refund or Exchange. Please only purchase our machines if you agree to our terms and conditions. Due to the nature of use these bikes are impossible to warranty beyond the 30 days stated. Please note: any Engine seizures are Strictly Not covered Under our Terms and conditions. 

All machine nuts and bolts, tyre pressures and steering should be checked by a competent adult before every use. Accidental damage should be attended too immediately and damaged parts replaced as soon as possible. Helmets and suitable protective clothing should be used at all times, under adult supervision. 

The warranty does not cover: -

15.1 Engine seizures, Pull Starts, Gear Boxes, Chains and Sprockets, Clutch's, Wheels, Tyres - Innertubes / Batteries / Chargers / Motors / Speed Controllers.
15.2 Misuse, Neglect, Abuse - Water Damage caused by the Weather, wet and loose muddy and sandy terrain,  Power washing or Hose Pipe, etc.

All products should be cleaned with a damp cloth only. 

15.3 Accident, Stunt riding, Competiton, Off road track, Racing

15.4 Lack of maintenance and servicing

15.5 Bad repair or alterations or modifications

15.6 Inappropriate use, incorrect operation or a fault created through incorrect fitting eg. -impact damage, hazardous liquid damage, exposure to extreme heat/cold or other damage caused by acts of God or incorrect fitments)

15.7 Any damaged which may have resulted in inappropriate use of Water, i.e Power washing, Hose pipe, Wet weather conditions. ( All products should only be cleaned with a damp cloth ) Never pressure wash any Electrical components! )

Any of the above not approved by Xtreme Bikes in writing then all parts of the warranty will be VOID

If the product needs to be returned for any reason other than damaged in transit, the customer is responsible for all return postage costs, including broken / damaged parts and warranty items. Please note that once our products have been assembled and used. we do not offer a cash refund or Replacement, but  instead we will gladly help with any future parts needed. Most parts can be purchased directly from our website. If parts needed are not listed please send an email to sales@xtremebikes.co.uk and we will quote you a price.

As with all Mini Moto products we offer a 30 day parts only warranty. This does not cover Engines seizers and punctures as this could easily be caused by insufficient 2 stroke oil or the terrain the vehicles have been travelling on. Also please note that once the machines have been Fuelled / started and used they cannot be returned for a refund or Exchange. But we will help with replacement parts wherever possible.  Please only purchase one of our products if you understand our warranty and Guarantee procedure. Due to the nature of use of these machines it would be impossible to warranty beyond the 30 days stated.

If we accept the return of a product for service or repair, we will where possible use our own labour force to make the bike work to its full potential, however on the rare occasion the item may need to go back to the manufacturer and for this instance we'll organise for the product to be sent back to the relevant manufacturer or distributor. Due to the process and logistics involved, it may take up to 6 weeks for a product to be received, sent to the relevant manufacturer for repair, returned to us and then finally sent back to the customer, however the average time is 4 weeks. 

 

16. DISPOSAL OF PARCELS

ln the event of insurmountable obstacles when carrying out delivery or when a Parcel has been returned for service or repair due to manufacturing defect. If the product found not to have a manufacturing defect, the Service Provider will reserve the right, after any compulsory period of storage, to dispose of the goods in the following cases (unless stated differently):

- If we are unable to seek clear instructions due to lack of communication provided by the Recipient /or the customer or if we unable to identify the Customer and/or the Recipient. The Customer or the Recipient will be deemed to be unidentifiable if neither can be reached or identified within 30 calendar days;

- If the goods in question are perishable; if the goods pose a hazard to people or property; or if the goods have been returned for (manufacturing defects) this later found to be void.

The Customer will be required to reimburse Xtreme Bikes Ltd Company or the Service Provider for any storage costs and expenditure incurred through their disposal. This amount should not exceed £6.00 per day for storage costs from the date of the refusal of any return items.

17. DESTRUCTION OF PARCELS

If the preconditions set in disposal of parcels, unless stated differently on the website www.xtremebikes.co.uk the Service Provider or any Member of staffs involved in the delivery / service / returns or repairs of any products will reserve the right, after any compulsory period of storage, to destroy goods if they cannot be disposed of or sold and provided that doing so is not in violation of the Customer's interests as may be apparent to the Service Provider.

If we are unable to seek instructions due to lack of information or if it is unable to identify the Customer and/or the Recipient within 30 calendar days, the Service Provider will wait for an additional period of 30 calendar days. This additional period will not apply in the case of perishable goods, goods which pose a hazard to people or property, or in the event of an official order.

The Customer will be required to reimburse Xtreme Bikes Ltd for any storage costs /or increased disposal cost s /or over expenditure incurred through their destruction. 

18. LEGAL DECLARATION AND DISCLAIMER

All Xtreme Bikes Products are NOT ROAD LEGAL and should never be used on public roads. The purchaser is solely responsible for the use of the minimoto and must strictly adhere to all Government Laws that are in force. Do not use on wet, oily or icy surfaces. The minimoto is designed for children from 14 years upwards and should be supervised at all time when riding the bike by a responsible adult.

 

OFF ROAD USE ONLY:

Important Information; All Mini Moto Products are NOT Classed as Toys, they are officially Classified as OFF ROAD USE ONLY, due to the High Powered Engines and the top speed or around 25-35kpm

Due to off road build quality and performance means they are not covered by the Machinery(safety) Regulations 2008 or BS EN 71.
All Xtreme Products are CE marked as standard with their own Vin number or item I.D number.

Most Mini Moto Products fall outside BS7407: 1991 as they are classified for off-road competition use only, and Never to be used on the Public Highway.

Officially Mini Moto Products are designed for Riders over 14 years of age, although it is always parents dissection that the final decision on the suitability or age of the person riding our products.

It is always recommended that an Adult Supervision and Protective Clothing is required at all times.

 

RECCOMENDATION

We strongly advise that the customer has or knows someone with good mechanical knowledge who can carry out servicing/ general maintenance/ repairs and replacement parts when purchasing any Mini Moto product. You should expect that parts will need replacing from time to time, chains and brakes will need adjusting, steering and all other moving parts will need checking and lubricating prior to each and every use. Mini Motos are designed to be used Off Road, you should only buy one of these types of machines if you have access to somebody who knows the basics of how to carry out servicing and repairs and the general upkeep of the mini moto product. From time to time the customer will require to replace any items that may become defective due to every day wear and tear and parts under warranty.

We recommend that any (Petrol) Off Road product should be firstly run in for the first several days and should not be continually used on full throttle for long periods of time. It is strongly recommended that a good quality 2-stroke oil is used at all times, and the correct mixture of oil and petrol is measured in the mixing bottle each time of use. (Electric Products) Never use or ride your electric product in damp / wet / muddy / snowy conditions, these bikes are not made for water, so never use pressure washers or hose pipes to clean down your product. If in the event of any claim water damage found, or has been the contributor all warranty will be void.

We have a vast range of Spare Parts covering all of our products range, Unlike other Companies who have very limited parts ( If any ) we have 1000s of Spares Ready Available to despatch at such short notice ensuring your item will be up and running as soon as possible.

 LEAGAL DISCLAIMER

Purchaser accepts FULL responsibility & releases Xtreme Bikes, Shane Wood and Claire Wood of ANY and ALL PERSONAL INJURIES, FATAL INJURIES, ANY LOSSES, COSTS, OR DAMAGES incurred as a result of the Purchaser's operation of this item. The purchaser is solely responsible for the maintenance and safety of the minimoto and when permitting other riders to ride this item, and assumes all responsibility in event of damages, injuries or fatal injuries etc. Purchaser is solely responsible for understanding and abiding by all Governmental/ Police Laws for operation of this product.

RETENTION OF TITLE The legal and equitable title to the goods supplied under the contract (in this condition referred to as "the contract goods" which expression includes any of them) will not pass to the buyer until the price for the contract goods has been paid in full or until such payment have been received Xtreme Bikes owns all products until the customer accepts the goods upon delivery.

Before each ride: All nuts/ bolts, tyres and steering, chain tension, oil mixture, brakes, carburettor, fuel pipes, fuel filters, pull start, spark plug, wiring and all serviceable parts should be checked by a competent adult before every use. It is recommended that a qualified mechanic should assemble and check over all aspects of the product before allowing any persons to use the bike, quad or scooter off road. Accident damage should be attended to immediately and damaged parts replaced immediately. Helmets and suitable protective equipment should be used at all times and always use our products under strict adult supervision.
